Legal Question in Landlord & Tenant Law in New York

Hi, my friend is currently one month into serving a six month sentence in jail. His landlord, whom I also know wants evict him for non payment. She says he has two months to remove his possessions (which of course he can't do), or she's keeping the furniture. Can she do this to him? Thank you for you help. Joe

If she evicted him, then she is entitled to remove his furniture. If she did not evict him, then she cannot.
