Legal Question in Landlord & Tenant Law in New York

housing issue

I was conned into subletting an apartment and to my surprise i just found out that she had no right to that apartment due to a disposess. Unfortunately the super of the building granted her access illegally and that's how she was able to run her scheme. What can I do now to avoid getting kicked out of the apartment immediately by the management? Please any advice will help being that I have my 4 month old daughter and wife there.

Re: housing issue

Even a squattor (someone that does not have legal possession of a premises) has certain rights. The landlord must properly commence and maintain an eviction proceeding.

The fact that a super in the building aided and abetted a fraudulent scheme may be actionable against the landlord.
