Legal Question in Landlord & Tenant Law in New York

my husband and i signed a one year lease in the town of brookhaven, ny. we moved out early after finding out that the apartment was illegal. They are suing us in small claims for breaking the lease early. Can they sue us? Can we sue them for renting us an illegal apartment without our knowledge and using us to make illegal money?
