Legal Question in Landlord & Tenant Law in New York

will i be able to go to small claims court over this issue

I live in an apartment building and a

former friend of mine put a hole in

my bedroom door one day. My

roommate was there and witnessed

the whole thing. This former friend of

mine then told both of us that he

would come back the next week to

fix the hole in the door. It has been

about 3 to 4 weeks now since he was

supposed to come and fix the door.

Me and my roommates also have to

move out of the apartment in

another month. If he fails to fix the

door and they keep our security

deposit because of this damage to

the apartment would I be able to

take him to small claims court for

either the amount of our security

deposit or the amount of how much

the door would have cost to be fixed?

Yes. You would be able to take him to small claims. The cost would be the amount to fix the door. You should receive 2 estimates to fix the door, or, fix the door and then sue the former friend for your actual out of pocket cost.
