Legal Question in Medical Malpractice in New York

common sense to check potential head injury?

Suppose someone went to the emergency room due to a hard fall and it turned out the patient needed shoulder surgery. No CAT scan or MRI was done. Months later an 'untreatable' giant aneurysm in the brain was dicovered. Was it negligence, that the ER doctor did not look at potential damage in the brain, so that the aneurysm could have been treated when smalled and safer for a bypass?

Re: common sense to check potential head injury?

In general terms, CAT scan and MRI should have been done. You may have a medical malpractice claim against the doctor and the hospital. In order to determine if there is a viable legal claim, a complete review of the entire medical record should be carefully reviewed. Feel free to call my office for a confidential free consultation.
