Legal Question in Medical Malpractice in New York

someone please help

Hi there,

I've been searching for a while and couldn't get an answer for this. Any smart, educated, and good-hearted lawyer(s) please let me know about these simple questions:

1) Is it possible to sue a psychologist for malpractice who after years of lousy and intimidating ''treatments'', refused to finish a treatment and threw patients out in the middle of it for NO LEGIT REASON AT ALL ??? (patient suffered from bad accident and was referred to him)

2) What's the time limit to file a suit, starting from the date of the last session/treatment? (A year, two years????...)

The statute of limitations for medical malpractice is 2 1/2 years from the time of the malpractice. Where there is continuous treatment for the same condition, the statute does not begin to run until the last treatment. As for your case, you do not provide enough facts to determine whether you have a case or not. Under New York law, in order to bring a medical malpractice case, a doctor would have to review the matter and express an opinion that malpractice has occurred.
