Legal Question in Personal Injury in New York

Can a 12 yr old be sued?

My friend was ''attacked'' at an ice skating rink. We were hanging out, and a kid came at him. When my friend went to DEFEND himself, he broke the kid's nose. Is that self defense? Can he be sued?

Yes..

self defense is a defense...not a bar to any action. But, if therre is a suit, IMMEDIATELY turn the suit over to the parents homeowners insurnace company/broker.
