Legal Question in Personal Injury in New York

workmans compansation

i injured my back on 10/19/98 after a long battle w/ ins. company both my physician and the I.M.E. examiner recammend surgery which i am not comftorable having and i would just assume settle am i bound to the surgery . they ins. co. also say,s they are not interested in settleing now under sec8-15 i believe , what are my options. thanks

Settlement with the insurance company is usually called a Section 32 settlement and you give up any rights to have the carrier pay for the surgery and it is very risky for you especially if you return to some kind of work and hurt your back again. Their is no way that you can make the insurance company settle. If they don't want to, that's it.
