Legal Question in Personal Injury in New York

automobile accident : claim for Pain and Suffering

We met with a severe automobile accident a year and a half back and have filed a claim for Pain and Suffering. The facts of this case are:

1. The accident happened in NY and was not our fault.

2. Our SUV was pushed off the road, hit the railing and rolled over at least 4 times before it came to a stop on its side.

3. As a result of this accident I fractured my right index finger and required surgery to fix it. Even after months of physical therapy, I am still not able to use the finger properly as it cannot bend.

4. My wife was also in the SUV at the time of the accident. She broke her right wrist. Treatment involved surgery for permanent screw fixation. She still experiences pain in her right wrist and has not regained complete range of motion.

5. My wife's brother was also in the SUV at the time of the accident. He was hit on the head and ruptured his scalp. More than 10 staples (stitches) were required to patch up his scalp.

6. Apart from these major injuries we also experienced back and neck pain and had severe bruising on several parts of the body.

We were on vacation when we encountered this deadly accident. I would like your opinion on the amount that I can expect on this Pain and Suffering claim.

It is nearly impossible to give you an exact figure as to how much your case is worth. Many factors are considered, including the amount of your medical bills, the prognosis of your injury, the facts of the collision, what insurance companies are involved... to just name a few.
