Yes. New York is a no-fault insurance state. Insurance for treatment and lost wages comes from the insurance carrier for the car you are riding in. If you have serious injuries you can sue for pain and suffering. I handle these cases so fee free to contact me.

If you do not have a household vehicle for no-fault benefits, you may have to get treatment on a lien basis. If you are seriously injured, feel free to call my office at 718-616-1414 to discuss your case.

You don't say whether you are the owner and registrant of the uninsured car. Presuming you are, there will be no no-fault payments of medical bills. However, if you have health insurance, claims could be submitted to the carrier. In any case, you may sue the owner/drive of the other car for medical payments, lost earnings for time out of work, and pain and suffering (provided your injuries are "serious" under the definition in the law).
