Legal Question in Personal Injury in New York

Hello, My car was recently backed into well it was legally parked and without me in it. The person stayed and wrote down there information for me and I also have a couple witness' who saw the whole thing. I never took pictures though. He really didnt want to go through insurance so I decided I would put my trust in that he would pay me. While now hes not paying. I never did small claims court but I was wondering what I should expect for lawyer fees and also if I have enough evidence to pursue. thank you very much.

You don't say how much damage was done to your car, but if you believe it's less than $5,000 go to Small Claims Court yourself. A lawyer is not necessary. If you take this path, you'll need to produce an eyewitness, and either a certified paid bill from a body shop, or the body shop mechanic himself for testimony (he'll likely charge for his time in court). An estimate won't be enough. Photos of the damage, while helpful, are not required. Best of luck. MEZ
