An engineer made a mistake on plot plan

In NYS: An engineer I hired made a mistake on a plot plan he prepared 9 years ago. I have now have been made aware of a problem which has cost me a financial outlay. Can I sue for damages or am I past that point in time?

A claim in negligence must be made within three years of the date of the negligent act, not the date of discovery. Similarly, a breach of contract claim must be made within six years of the date of the breach, not the discovery. Best, M. E. Zuller

This matter sounds more like a contract issue.
