Legal Question in Personal Injury in New York

mva on the job

i was a passenger in a mva on the job in 12/03..driver of work van lost control went off road and flipped over.i have been outta work since and im now classifed permt disabled..i know in ny u can not sue your employer,but am i able to sue the driver or insurance company!!every time i have court for workers comp they ask if i intent to sue! so who can i sue because i cant keep living reciving such small payments from ssi and workers comp! any help is greatly appreciated

If the accident occurred in December 2003, your claims are time-barred by both New York and Florida's statute of limitations.
