Legal Question in Personal Injury in New York

In my former place of employment I was falsely accused of threatening my supervsiors resulting in my mental heath arrest in 12/07. I have a pending lawsuit against my former employer for false arrest.Two months ago in discovery I read the false claims mase against for the first time . CAN i NOW SUE FOR LIBEL AND SLANDER?

I do not think that you can. These claims are in the form of a counterclaim in a lawsuit and are defenses in the lawsuit. If you believe that the counterclaims and defenses are frivolous speak to your attorney about sanctions and penalties.

Since you already have Counsel your question is better directed to them. Generally the answer is no, you are protected from slander and libel suits in legal proceedings.
