settlement questions

my case has settled on may 5,2008 and they were looking to get me an expedited check as soon as possible.now it has been seven months what shall i do?

Any attorney would need much more information to answer your question, which I suggest you resubmit with the following information:

1. Who did you settle with?: The City of New York? An insurance company? A private individual?

2. Did the parties enter into a written settlement agreement/stipulation or was it merely verbal? What does the written agreement say regarding payment?

3. Have you executed a Release and sent it back to your attorney? Has your attorney delivered the release to defendant? How was it delivered (e.g. Certified Mail? Regular Mail? FedEx?) How long ago was it delivered?

In New York, defendants have thirty days to pay upon receipt of closing papers, unless you've settled with The City of NY which is given 90 days. You should call your lawyer and have him/her look into the delay, and report back. Good luck. Best, M. E. Zuller
