Legal Question in Personal Injury in New York

what is it worth...?personal injury @ work place!

A friend of mine just had an accident at his place of work , he's a doorman from ny and he's only been employed there for a few months. but the unthinkable happened; a lamp fixture fell on his head neck and back from at least 6 or 7 feet above his head. he feels pain and is not really sure if he could even walk to work, he's wondering if its worth seuing and how much could he receive?

The value ofthe case is largely dependent upon the nature of the injuries and the reason for the accident. Without reviewing the medical file, it is impossible to answer your question. However, given that the light fixture should not have fallen, he may have a case. He should also pursue worker's comp.

I received your message on 9-8-2000.

If your friend was working, it is worker's compensation. He should have received worker's compensation.

If the building was owned by someone other than the employer, your friend may have a lawsuit, provided that notice of the defective condition, through any means, can be shown.

You have 3 years from the date of the incident within which to sue.

Please contact me directly with any further inquiry.

Good Luck.
