if a buyer didn't meet the dead lines to get approved until after the closing date can the seller back out of the contract in new York. Also never asked for a extension on the contract

Subject to the performance of the required rituals on the Law Day, seller keeps the down payment and the property. Seller will also be sued for specific performance unless seller brought an action to expunge the vendee's lien. You need real legal advice.
