Legal Question in Real Estate Law in New York

I am a co-owner of property that my father left my brother and I in Broome County, NY. I reside on the property and have for almost 30 years, my brother never has. He has not paid taxes nor performed any upkeep or maintenance in 9 years. Does this constitute abandonment and can I legally have his name removed from the deed?

No. He is an owner. You may have a partial lien for the expenses incurred.
