money in escrow

my attorney is remitting monies he stated he had held in escrow to pay for the purchase and installation of my patio awning. However, the funds for the awning were prepaid by the previous owners of my home back in october 2006. The mechant also states that they are full paid. I have been in my home for the past 5 months, should I as the new owner be the recipient of this check, once the merchant realizes they have been overpaid? I am listed with company as the new owners as well. If not who should get the money back?

Don't take money you don't deserve; it is a crime and will come back to haunt you. If you know you don't deserve it, don't take it and let them sort it out.
