Legal Question in Real Estate Law in New York

Can I sign on a USA Affidavit from Israel?

Hi,

I have a real estate property in the USA that is under my name and I want to sign on a Affidavit declaring a things about it to someone.

Is there a way I can sign on the USA Affidavit in Israel without having to go to the USA and sign on it? Can it be done via the USA Emmbassy in Israel? Is there any other way?

Thanks in Advance,

Meytal

This really depends on what it is you are trying to accomplish with an affidavit. If it is simply to state something about your ownership of real property (rather than to attempt conveyance or mortgaging of such property), your affidavit executed in Israel should generally be sufficient. It may be helpful to do so in front of a U.S. consular official (who is authorized to act in a similar capacity as U.S. notary public) if you plan to use this affidavit in the U.S. as documents notarized by Israeli notaries may or may not be accepted in the U.S. For any transfers, though, you may have to execute a power of attorney in favor of someone who is physically present in the U.S. and make sure in advance it is acceptable to the other parties in the proposed transaction.
