Legal Question in Real Estate Law in New York

Zoning question

I am living in a home I purchased a year ago, and part of my property is on town property. (at least half of my driveway.) The town is now planning on knocking down all woods that border my driveway and building a parking lot there, which will also go over onto half of my driveway. (They are building a ''sitting'' park across street & claim they need lot for cars. There is a municipal lot just down the street!!)I want to know if there's any way I can fight this, since land has been that way si nce house was built in 1913 and never been used for anything til now.(They also built a nuclear plant siren on the lot last week!)

When the government takes over property from an individual it is called condemnation. In a condemnation proceeding, an individual is reimbursed from the government for his loss.

Since the town is presently in the planning stage, the best way to fight a proposed condemnation is to contact the Town Board - and the local media, and make your objections known.
