Legal Question in Traffic Law in New York
I've been hit
I was making a left turn with my signal on, a car was stopped to my left at a stop sign. As I was making the turn, the driver decided to go without me completing my turn. She hit my car and made a nice dent, no one was injured. I didn't make a police report and didn't take her insurance information because the driver told me that she has no insurance. I got all the rest of her information such as phone number and address. After I mailed her the estimate of the damage she had caused, I tried to make a police report, where they told me that there is nothing they can do but to input me in their computer. Recently she sent me a letter saying that she doesn't have the funds at this moment due to her personal problems. As it seems she is trying to not pay me. I'm thinking of taking her to small claims court, do I have a case?

Sue her in small claims court----you need either 2 estimates or a mechanic in court to testify as to the damage amount.
