Legal Question in Wills and Trusts in New York

my wifes mother died & she is in her will for her house ,being her husband do i have any part of the home?

I am not sure I understand the question. Looking at your question as a trust and estates attorney, the answer would be no. Your wife would receive the house. You are not in the will.

I agree with Mike - not being in the Will, you have no part of this. If it is never used as marital property it belongs exclusively by your wife, and she is free to do whatever she wants with it. Unless she has other obligations to her family members, she can create rights for you by placing you on a new Deed, along with her, but she is not obligated to do so.
