Legal Question in Workers Comp in North Carolina

I have worked as a manager of a shoe store for over 11 years when I injured my back which required back surgery. My employer discontinued my personal insurance a month before going out of work for surgery but continued to take my portion of the insurance premium out of my check two week prior to my surgery. Can this be done?

While you are out on workers' compensation leave, the employer is not required to continue your health insurance unless the employment is subject to FMLA, etc. However, your situation is different because you were paying the premium.
