How Do I Fire My Lawyer?

I am not happy with the way my lawyer is handling my personal injury case from an auto accident? I do not want him as my attorney ANYMORE! I signed a contract over a year ago stating that he would get 25% of the settlement. How can I get out of that?

You simply fire him. I would advise writing him/her a letter informing him that you no longer desire his/her services. However, before you do so, I would also advise you to have a new lawyer in place to handle your matter and to receive your file.

Your current attorney's contract likely states something to the effect that if you do terminate his services before trial/settlement, you will be responsible for all fees EARNED to that point at the rate of $--- per hour. Ask for an itemized invoice. The file is yours, the clients, however, a lien may arise on the file until you do pay for any work already done.

Fire him, but make sure you have another attorney who is ready, willing and able to take your file and immediately start representing you first.

Your current attorney will have a lien against your file, but he can't stop you from finding someone else.

He will be entitled to the value of the work he has done for you so far, so you may end up having to pay him off to get another attorney to take the case.
