Legal Question in Civil Rights Law in North Carolina

received a civil summons, what do I do?

Me and my husband had a car loan and we were going through financial difficulties about a year ago. Our car was repossed in Oct of last year. They sold the car and now we owe the remaining of the balance which is $8,000+ and we can't pay it. Yesterday we received a civil summons for this amount. What should we do because we know we owe them the money but we don't have the money to pay them. Also I heard that they could put a lien against our home, is that true. Please help us.

Re: received a civil summons, what do I do?

You must file an answer to the summons within the time stated on the front or bad things could happen. Call the Legal Aid Society and see if they can help you. You are entitled to an accounting of the difference between the sales price of the car and the loan balance, and to know if the sale was conducted reasonably to get you the most for your car. Obtain legal representation if you can, but don't neglect the summons.
