Fair Credit Reporting Act Violations

After several calls and letters to the collection agency, original creditor, and credit bureaus, I can't get an erroneous charge removed. I sent documents to show proof of payment to them all. The credit bureaus won't accept my documentation (they just ask the collection agency if the account is valid), the collection agency just sends my information to the original creditor to ask if this is a valid account (the original creditor always say yes), the original creditor can't find their own accounting error. It's obvious when you comapre the outstanding bill they finally provided me as proof I owe money doesn't show my last payment. My payment is substantiated by a credit card statement and letter from my credit card company. What can I do if my receipts aren't accepted as proof of payment? This has been going on since July 31, 2007. I filed a complaint with the FTC today and they suggested that I sue. What should I expect if I sue? How should I prepare? Where can I find the appropriate attorney? Did they have the right to run my credit without my permission and before contacting me to give me a chance to dispute the account? The offending collection agency is in Concord, NC. The original creditor is in Dallas, TX.

Try contacting an attorney that deals with debt collection for a referral or a bankruptcy attorney.

Unfortunately this is a bad situation for you right now but once you get into court, they may be in a hurry to settle. Also, it is possible that a letter from the attorney could do the trick.
