Someone I know was charged with 3 counts of 2nd degree child pornography. What constitutes 2nd degree child pornography?

A person commits the offense of second degree sexual exploitation of a minor if he or she records (films or photographs in any way) material that contains a visual representation of a minor engaged in sexual activity; or distributes or solicits that type of material. It is a Class E felony.
