Legal Question in Family Law in North Carolina

divorce when he cannot be found even by police-he has warrants

I left my husband 3 years ago. I tried to file a do-it0yourself divorce here in Craven County and it got rejected. I want to put this awful marriage behind my and get divorced and get my maiden name back asap. He has warrants for his arrest NO ONE knows where he is...what do I do? and is there a way to get financial help to do this? I am a college student at age 37 trying to get my life back together but only made around 6000 dollars last year according to w2's...Help me please!

The divorce should be a straightforward proceeding. If you have been living "separate and apart" for one year, then you are entitled to the divorce. The only issues are filing the paperwork and having your husband served with the papers. If your husband cannot be found, you may have some alternative method of service under the circumstances (e.g. last known address, or by publication). I would suggest shopping around and looking for a lawyer to help you with.
