Legal Question in Family Law in North Carolina

divorce

Is it legal for a father who is

divorcing a woman to take their two

children out of state for 10 days

without her consent when she is the

primary caregiver and homeschool

mother? Can she get a temporary

restraining order to prevent this?

Divorce is not complete and he is not

willing to mediate.

Re: divorce

Is there a custody order in place?

A petition can be filed for an expedited hearing on this issue. If you have a lawyer talk with them otherwise you need to locate a local attorney for this issue.

good luck to you.
