Legal Question in Family Law in North Carolina

Obtaining Divorce Papers

How do you obtain divorce records, if the Court House in the County where the divorce was granted says that they have no record of the divorce?

Details: My brother in law is trying to obtain a copy of divorce papers from his first marriage. He and his first wife filed for divorce, physically went before a judge, received signed papers, everything. Now, he can not find his copy of the papers, and the ex refuses to help by letting him get a copy of hers. They have been divorced for about ten years now. They were divoced in Stanly County, Charlotte, North Carolina.

You could also have an attorney locate the record of the divorce. Westlaw, an online legal research database, allows you to find Divorce Judgments by name and state. Once the record is found, you will know the exact county and be able to obtain a copy of the judgment.

The only way to get it is from the Courthouse - they may have the wrong county - Charlotte is in Mecklenburg county. Or try to convince the ex to give it to you.
