Return my Father's urn

My Dad past away in 1995. It was decided that each of the children would keep the urn for 6 months and then pass him on to the next child. Well sister number one got him first and refuses to let anyone else have him. She said she would pour out his ashes if we tried to make her turn him over. Please help me. My Mother and my other sister would like to have him with us also.

You have a very unique problem and I would strogly suggest that you get a second legal opinion, as I have never encounted this situation and am not confident that I am the best source of advice. However, I will say the following. The ashes are personal property. By way of agreement, the ashes belong to all of you. Since your sister is not living up to her part of the agreement, I believe that your only recourse would be to sue her for breach of contract. Again, this is a rather novel situation and I think you should ask another attorney, or check back with this site to see if another attorney responds. Good luck.
