Legal Question in Family Law in North Carolina

I work with teen mothers in North Carolina and have a client that is living with her boyfriend's family. The father is on the birth certificate but their relationship is over. Can the Mother move out of state and take her daughter with her or does she have to petition the court?

If there is no court order to the contrary and she is 18 or older, she can pretty much do what she wants. Her best bet is to sit down with the father and his family and have everyone work out some sort of plan that allows her to move but also allows the father to pay reasonable child support amount that leaves him with the funds to have visitation. If they can not come to some mutual and reasonable decision and she leaves - she better have a feasible plan and / or decent support system in place to take care of her and the baby where ever she is going because if the father / his family object and go to court - the baby could be coming back to NC.
