Legal Question in Civil Litigation in North Carolina

Accident at school

My grandson was involved in an accident at school where he was knocked off a slide and landed on a child under the slide and smashed a vertebra in her back. She was in the ER for 7 hours and is currently wearing a potective corset for her back. This incident happened on April 28th and the child is back in school today, May 4th. I contacted the mother and father and said how sorry I was for not only her child but for my grandson as well. The mother started to quote cost starting at $5,000 and another $1200 for the corset. I explained I was a widow with a limited pension and work at a church. I receive no income for Tanyon and would like to help; however, I don't have the money and further monies she is starting. The teachers did not know what had happened since they were not watching that area and of course are stating that my grandson should not have been standing on the slide. Please let me know my legal rights. Can I be sued?

Based on these facts, you could not be (successfully) sued. This is probably just a childhood accident, and in any event unless the child had a history of such behavior, of which you were aware and which you could have controlled, you would not be liable.

I agree - but out of an abundance of caution, if you have homeowners' insurance, you should mention it to your agent. There may not be any coverage, but if there is, your insurance company will help you out.
