My son was drining the family car when he got into an accident. The accident was in Washington State (5 years ago). The passenger in the car my son hit is sueing our insurance company (300,000) max. The insurance company believes it is a small claim (whiplash), but they have decided to take it to court. No one can say what the outcome will be. The court date is sometime in Sept 2007. If an award were to be greater then 300,000 what assests could i loss and is there a way to protect mayself?

There was no major medical operations or hospital stays. Just vitis to doctor office and complaining of pain. Person was injury before the car accident but is saying it has been re-injured.

Accident happened in Washington State, but I have since moved to North Caroline. So please let me know if there is a diffrence from one state to another?

It sounds as if your coverage will be plenty in view of the injuries. If, however, there were an "excess" verdict, then your assets would be collectible, subject to several items which you can exempt. You can retain a lawyer to advise you as to your risk, to deal with your insurance company, and to advise you as to protecting your assets.
