what is procedure to file a civil suit upon a bank that is forclosing on my home to make them produce the original note and that they have followed GAAP in their bookkeeping procedures? i live in a nonjudicial state.

You need a real estate litigation attorney who specializes in defense of foreclosure actions. You do not file a separate civil suit. You defend against the foreclosure action and request them to provide a copy of the note.
