I have answered this question before so you might want to look through my previous answers. On whose land do the tree roots grow? And was the tree damaged or diseased in any way and did the owner of the property on whose land the tree grew know anything about this?

The owner of the land is only going to be liable for damage caused by his/her tree IF the tree was diseased or rotten AND if the owner had notice (preferably written) of the dangerous condition of the tree. If a windstorm came and knocked over a healthy tree and the owner had no knowledge, then the owner is not going to be responsible.
