Legal Question in Civil Litigation in North Carolina

My son went to school and the principal think he was cheating on a test with his iPod. They confiscated it then asked him for his passcode for it and then went through all his photos some were NAKED photos of himself and some on the internet. I think this is a extreme invasion of privacy even though the Principal thinks he was cheating i dont think it gives her the right to take it that far. Do you think we will have a case if we took it to court?

Probally not but feel free to consult with an attorney. First, your son should not have taken an iPod to school. School is for learning, not be-bopping around with an iPod shoved in your head. Second when he was asked for the passcode to access the iPod he should have squarely told the school officials no. If the iPod was only accesible with a passcode, to have given the school officials the passcode was extremely stupid, especially in light of the fact that presumably he knew there were naked photos of himself. You should actually be more concerned about your son having naked photos than the possibility of a law suit.
