how would I get the limits of liability from a car insurance company that was totally responsible for the accident without going to mediation?

This question is a little confusing because of the reference to "mediation." Typically mediation occurs only after a lawsuit has begun, in which event a person probably has an attorney, and they can use "discovery" techniques to find this out. I am assuming, however, that your question is basically how to find out the insurance limits prior to a lawsuit being filed.

We would need to know more about you specific situation to give a thorough answer, but in general, there may be one statute which allows you to obtain this information from the insurance company. You can view the statute here:

You may want to write to the insurance company and specifically reference this statute. You will, however, be required to provide them with e.g. your medical records. After a lawsuit is filed, you can fairly easily find out their limits in North Carolina.
