Injured on premises of major nationwide retailer-now lying thru teeth

Hello,

I was injured on the premises of a major retailer in 12/2003. I had the foresight to file an incident report. I found that I had increasing knee pain over the course of 2 weeks after incident, and saw an Orthopaedic Specialist. Thought I had a torn meniscus. Had initial arthroscopic procedure and then found problem much more serious. Had second open knee procedure in April, 2004. The medical bills alone are now in excess of $50,000. I was out of work for 8 weeks after 2nd surgery, etc. I contacted insurance company- thought I should be entitled to recovery of medical and lost wages. They played around with me for several months. Unbelievably, they have taken, what I think is, a very dangerous approach to denying liability. First they claim there was no incident report filed that day of incident-I have a copy of the top sheet which I demanded that day. Second, in hopes that no attorney will help me, they have claimed that I gave 2 diff. locations for fall. Untrue!I'm an excellent historian, and know exactly what happened, and what I said to whom.They think that I will go away in defeat-Any suggestions on where to go from here?This is a very winnable case-I am so fired up by these liars. I need help!

It sounds like you have documented everything very well. To evaluate your claim, an attorney would need to review your medical records and investigate the facts relating to how you were injured such as whether you fell, tripped, something fell on you, an employee did something, etc. I suggest you call William Goldfarb in your area and talk with him about what happened to you.
