Legal Question in Real Estate Law in North Carolina

property

two months ago my common law husband and I purchase a home in N.C. we live in N.Y. and our plans were to relocate to N.C last week he died, my name is on the deed. Not on the loan application, we have one son. He left no well. What can I do.? His mother is trying to take over. He was 36 years old.

My condolences for your loss. If your name is on the deed then you certainly have an interest in the property. I would need more information on the exact "wording" of the deed and other assets owned by the decedent upon his demise. The law where the property is located will control as far as your rights in the property. Therefore you would want to contact a NC attorney in the County where you purchased the property. Most likely, if you were both on the deed, you both own a 1/2 interest. His interest would pass to his estate.
