Legal Question in Wills and Trusts in North Carolina

Responsibilities as administrator of parent's will

My sister and I have been named as the administrators of our mother's will. My sister died recently. We were the only children and my father is deceased. Will my sister's share of any inheritance automatically go to her husband and/or her 2 children or does she need to redo the will to request this to be done? Her request was that all bills be paid before anything. She has requested certain personal items be given to individuals. All of these are listed separately in her will. Thank you for your help.

You need to read the will to see if her share will then be distributed per stirpes or per capita. If it is per stirpes, her share goes to her children, if per capita, her share would go to you.

Well, you can't "redo" a will after the person is dead. I am not clear if your sister had a will; if she did, this needs to be reviewed, along with that of your mother. You should seek a consultation with a local attorney for this purpose.
