Legal Question in Workers Comp in North Carolina

bankrupcy & workers comp.claims

I work for a major airline and was injured on the job,my attorney says we have a good case but my airline is possibly filing for bankrupcy, so now my attorney says we may get very little. Does this sound right? My company is self-insured and no one seems willing to say what a fair settlement is[ or was]. I'm starting to doubt my attorney has my best interests at heart since this has been ongoing for 1&1/2 years....any help will be appreciated

You say that your company is possibly filing for

bankruptcy and suggest that your claim was filed some 1.5 years ago. What's going on here? Are they going to pay the claim or not?

If they haven't filed yet, your claim, if legitimate, should be paid. However, once the company files for bankruptcy with no independent insurance carrier to pay claims, you're just one more unsecured creditor to whom they owe money who

will be lucky to receive a few pennies for each dollar owed.
