You can go to the North Carolina Industrial Commission and they have all the forms on-line for you to print out. Here is the link. http://www.ic.nc.gov/forms.html

However a Form 28 WILL NOT start weekly checks. A Form 28 is notification of your return to work. If you are in a situation where you were receiving checks and had a trial return to work but are now in a situation where you are out of work again, you could file a Form 28U or you could use a Form 23 (which is new). A Form 23 will result in a hearing over the phone with defense counsel and a Special Deputy Commissioner will preside over the hearing.

It may also be in your interest to consult with an experienced workers' comp attorney so that you can have an in-depth conversation about the exact facts and circumstances surrounding your case. The counsltation will cost you nothing and you will come out of it with a better understanding of what you have ahead of you. Workers' Comp is complicated, don't be afraid to get some help. I always tell my clients that I could not fix my car engine if it needed repair, I would take the car to someone who has the knowledge and experience necessary to do a good job for me. Talking to an attorney is no different.

Hope this helps!
