Legal Question in DUI Law in North Dakota

minor in consumption.

I'm 18 years old and I just got an MIC along with about 20 others at a house party, and the officer that gave it to me didn't give out any breathalyzers, and only got id's from those who had them with. We were all then told to leave after we got out tickets. Is there any way to fight this?

Re: minor in consumption.

The cops do not have to give breath tests to charge you with MIP/MIC. It is possible you may have a defense to the charge, but without more information I can not be sure. You should contact a lawyer and have them review your file. My office will do a free initial consultation.
