Statue of Limitations

I fell off of a scaffold without a safety Harnest, because thay did not have any.

This was 4 years ago. The doctors were saying there was nothing wrong with my shoulder. Three months ago my surgery was okayed and now I find out I can not sewecause the statue of limitations ran up 2 years ago, but mt lawyer could not do anything until my surgery. Is there anything I can do for my pain and suffering for 4 years?

Re: Statue of Limitations

The tort of negligence requires two elements:

1.The unreasonable behavior of the defendant; and

2.The injury to the plaintiff.

The tort is not complete until both elements are in existence. If you had no reason to know that you had sustained an injury, that is no pain, not limitation, you may not have had commenced the Statute of Limitations period. Examine this aspect of your situation very carefully.
