Legal Question in Consumer Law in Ohio
I live in Ohio. I started to apply for an auto title loan online (CA).
Once I realize the terms , I stopped the process. Never received a penny from company. Sent paperwork saying, I not want to do business and made several phone calls. They told me all was corrected and I moved on. But they had already put a lien on my automobile. ( I was totally unaware). Then a year later I tried to get a personal loan, now they are upset say I lied on application.
Do I have any recourse? And now the company is totally giving me the run around.....
1 Answer from Attorneys
You would want to sue in Ohio seeking what is called a declaratory judgment with regard to the validity of the lien on the vehicle. You would also want to bring Consumer Sales Protection Act claims for relief against them if the facts warrant. If you win on your CSPA claims, the Court has the power to make the other side pay your attorneys fees (if they are solvent).
