In Ohio, OVI is an M1 misdemeanor punishable by a fine of up to $1000.00 and 6 months in jail. Reckless Op is usually an M-4. I say usually because if they charge Reckless Op under a municipal instead of the state code, it can be less.

Often, the court will impose the same penalties you would have gotten for the OVI (only the fine amount will be lowered to the maximum for the M-4 and you will get the three day alcohol intervention program, but the important thing is that you won't have an OVI on your record and you won't be facing mandatory days in jail on your next one.

But other courts and judges will impose no jail time, no three day program, and treat it as if it actually were a straight reckless and give you a fine.

Reckless is four points against your license, whereas an OVI would be 6 points.

So the answer on your penalties question is that it depends upon the judge.
