changing custody

My x husband is currently residential parent.

Our son is not happy there he is 16 and wants to

be with me on a full time basis. What is his rights on being able to say who he wants to be with.

Ohio used to have an age of election but repealed that law. However, if you go back to court, Unless there is a compelling reason not to, I imagine the court will likely honor the request. Of course a lot does depend on the circumstances. The court will consider two factors, changed circumstances and the best interest of the child. These are extremely vague and subjective but that's the state of the law. If your son has strong feelings about this and/or a good reason, it's probably worth pursuing.
