In Ohio, you would want to go to the court that currently has jurisdiction over the divorce (sounds like Franklin County to me) and petition that court to alter the custody arrangement. You will need to argue that there has been a change of circumstances (the ex husband has lost control of the boy) and that it is in the best interest of the child that he be put in your custody.

You will likely want to have an attorney from the Franklin County area do this for you since there will be a hearing where you will have to present evidence on all of this.
